1. Scope of application and validity These general terms and conditions (hereinafter referred to as T&Cs) regulate the relationship between Tell a Friend Pascucci (hereinafter referred to as tellafriend) and the customer (hereinafter referred to as customer). These T&Cs apply to all services and products, both paid and free of charge, that tellafriend offers or provides. Customer conditions that conflict with or deviate from these T&Cs are not recognized. The current and binding version of the T&Cs is published on the Internet at www.tellafriend.ch. A written copy can also be requested at service@tellafriend.ch. 2. Offer The prices of our services and products on www.tellafriend.ch are generally binding and subject to price changes and errors. Any agreements to the contrary between the customer and tellafriend remain reserved. Since tellafriend does not manufacture its own products, only brand new original products are sold. In addition, tellafriend can also offer used products; these products are marked as "used". 3. Order, conclusion of contract and delivery A contract is concluded with the order in the tellafriend online shop, subject to the availability or deliverability of the products. The receipt of the order is confirmed to the customer with an automatically generated email so that the customer can check the content of their order. Any discrepancies between the content of the customer's order and the confirmation of receipt from tellafriend must be reported immediately. There is no right of withdrawal. The delivery dates and availabilities specified by tellafriend are only to be regarded as guidelines unless expressly stated otherwise in writing. The specification of a delivery date is made to the best of tellafriend's knowledge, but without guarantee. This applies in particular in the event of delivery delays. In the event of delivery disruptions due to circumstances over which tellafriend has no influence, such as pandemics, strikes, material failures, transport or operational closures at the manufacturer or supplier, tellafriend is entitled to terminate the contract. Order changes or cancellations requested by the customer require a written agreement with tellafriend. tellafriend can charge the customer for costs that have already been incurred. Please note that we are not obliged to deliver the ordered goods if we have ordered the goods correctly but have not received them correctly or on time. We are not responsible for the lack of availability of the goods. Of course, we must have informed you of this fact immediately. If the goods are subsequently unavailable, we will immediately refund any payments made. In the case of parcel returns due to incorrect address details, expiry of the collection period or refusal of acceptance, tellafriend reserves the right to charge the customer the applicable fees (return postage, cash on delivery fee, re-delivery). 4. Customer's obligation to inspect The customer must inspect the products immediately after delivery or collection for completeness, conformity with the order and for defects and immediately report any recognizable deviations and defects in writing. If a complaint is not made within 7 days of receipt of the products, the delivery is deemed to be in accordance with the contract, unless the deviation was not recognizable despite careful inspection. 5. Prices Our prices are net in Swiss francs including value added tax (VAT). The prices of the products and any additional costs are generally calculated according to the prices valid at the time the contract is concluded by tellafriend. 6. Terms of payment The following payment options are available to customers: MasterCard, Visa, American Express, Apple Pay, Google Pay and TWINT. 7. Warranty Customer claims are limited to the scope of the manufacturer's warranty. Unless otherwise stated, the warranty is valid for 24 months from the date of purchase. Manufacturer warranties that go beyond this must be claimed from the manufacturer. In the event of a warranty claim, this means that tellafriend accepts the item from the customer and forwards it to the manufacturer for repair. The right of return and claims for reduction and/or conversion are excluded in any case. tellafriend excludes any liability for any damage caused by improper handling. 8. Returns The return of the goods is at the responsibility and expense of the buyer. Tell a Friend accepts no liability for lost shipments. for fashion items & accessories For all purchases of fashion items at www.tellafriend.ch we grant you a voluntary right of return of a total of 14 days from receipt of the goods. Sending the goods on time is sufficient to meet the deadline (postage stamp). The prerequisite for exercising the right of return is that the goods are: • in perfect and unworn / unused condition - only for trying on (as in a store) • in the original packaging that is not stuck on and is undamaged • the item is complete and undamaged. Your right of return does not apply to custom-made, used, hygiene or damaged items. If the item is worn, dirty, damaged or smells bad, the return will be refused and claims for compensation may be made. The following applies to electrical items: If a product purchased from tellafriend.ch has defects or faults, the customer must send a precise description of the fault to tellafriend customer service at service@tellafriend.ch. The products are returned at the customer's expense and risk. Returns of products without a request from tellafriend will not be accepted and will be sent back to the customer at their expense. When sent, the product must arrive at tellafriend either in its original packaging or in perfect packaging. Electronic products such as CPUs, memory, graphics cards, hard disks, etc. must be packed in an antistatic cover, otherwise the warranty will expire. The following items cannot be returned: • Products that were not purchased from tellafriend.ch • Used products • Procurement products • Software and licenses • Opened products The customer is obliged to make backup copies of their data before returning them. tellafriend is not liable for data loss. 9. Data protection Customer data is only passed on to commissioned service partners (logistics & service partners) in order to fulfill the obligation arising from the purchase contract. The customer is obliged to treat their access data confidentially and not to pass it on to third parties. tellafriend accepts no responsibility for misuse of the access data by the customer. 10. Changes to the terms and conditions tellafriend.ch reserves the right to change the terms and conditions at any time. The customer must inform themselves independently about changes to the terms and conditions. The current terms and conditions are published at www.tellafriend.ch. 11. Applicable law and place of jurisdiction All obligations are subject to Swiss law.
